Manila (Philippine Daily Inquirer/ANN) - Philippine Airlines (PAL) employee Sarah Teresa B. Ocampo has filed criminal and administrative complaints against Filipinop party-list representative Eulogio Magsaysay before the Office of the Ombudsman and the House of Representatives ethics committee.

The case stemmed from an incident on December 17 last year at the Ninoy Aquino International Airport when Magsaysay, who represents the Alliance of Volunteer Educators, allegedly berated Ocampo, a PAL customer service agent.

Ocampo told the Office of the Special Prosecutor, which is under the Ombudsman, that Magsaysay was "verbally abusive" to her when she told him that it was not in her power to accommodate his request to be seated in the same row with his family at the business class section of the plane.

She said the congressman yelled at her, telling her to "shut up, you menopausal bitch!" He called her "bitch" four times, Ocampo said.

She said Magsaysay threatened to have her fired and that he would bring the matter to a "hearing" in Congress.

Ocampo asked the Ombudsman to secure the report of the airport security and the closed-circuit television recording of the incident.

Hours later, Ocampo formally accused Magsaysay before the ethics committee of grave slander, serious misconduct, conduct unbecoming of a high ranking public official and direct solicitation of personal favor or gain using his office.

She was accompanied by members of the PAL Employees Association (PALEA).

Apologies

In an interview with the Inquirer, Magsaysay said he would go out of his way to personally convey his apology to Ocampo and to PALEA, which helped the employee bring the two cases against him.

"That's her right," Magsaysay said of the filing of the case. "I have addressed this issue already and I've apologized several times to the media and in public."

Told that he had not personally apologized to Ocampo, Magsaysay quipped, "I understand that they're not accepting my apology. Nonetheless, I am willing to do, just say when and where. I'll try to get in touch with Ocampo and I will write PALEA today to express my sincere apologies."

Asked what took him so long to personally apologize, he said he did not know where to find Ocampo or how to reach PALEA.

Blaze trail

"We wish that Sarah's fight for justice will blaze a trail in the struggle for workers' dignity. Service workers in the airline industry and call centers among others suffer indignities in the workplace through no fault of their own but receive no protection from their employers or the government," said Ginalyn Licayan, head of the PALEA women's committee.

Licayan said there were many more Sarahs who need support and protection against abusive officials and insensitive customers.

The labor group Partido ng Manggagawa (PM) declared its support for Ocampo and a PM contingent joined PALEA members yesterday.

"Sarah's fight is the fight of all working women. We call on women workers and women advocates to stand up in support of Sarah against sexism and for dignity," PM secretary general Judy Ann Miranda said.

Miranda also questioned Magsaysay's credentials as a party-list representative for educators.

"Magsaysay's abusive behavior toward a woman employee exposes his pretensions as a representative of the marginalized. What underrepresented sector exactly does Magsaysay's Alliance of Voluntary Educators speak for?" Miranda said.

"It appears that Magsaysay as an advocate of the marginalized is as fictional as Mikey Arroyo (son of former president Gloria Arroyo) being a representative of tricycle drivers," she added.

MANILA, Philippines – The medico-legal officer who carried out autopsy on 12 of the 57 victims in the Maguindanao massacre was ill-equipped, a defense lawyer hinted.

During the cross examination at the trial today, Dr. Dean Cabrera, a medico-legal officer based in Camp Crame, admitted that he conducted the autopsy examinations without some of the regular equipment used for the procedure.

Cabrera, on the questioning of lawyer Sigrid Fortun, told the court that he had not conducted hemorrhage mapping on the clothes of the victims. The medico-legal officer also said he has no formal training on ballistics to determine the type of firearms used in the killing the victims.

Aside from a scalpel and a magnifying glass, Cabrera used a bamboo stick to probe the wounds instead of the regular retractable probe.

Microscopes and x-ray machines were not used to examine the fiber and wounds of the victims and determine the path of the slugs, Cabrera said.

Reyes dies in apparent suicide

MANILA, Philippines - Former Defense Secretary Angelo Reyes died Tuesday morning after sustaining a gunshot in his chest in an apparent suicide.

A bloodied Reyes was brought to the Quirino Hospital in Quezon City at 7:45 a.m. by his family, radio dzMM reported.

Doctors tried but failed to revive the former armed forces chief.

Reyes has been named as one of the corrupt military chiefs in the on-going probe into the Garcia plea bargain deal. -- report from radio dzMM

RH backers dismayed over exclusion of bill as priority

MANILA, Philippines - Backers of the Reproductive Health (RH) Bill expressed dismay yesterday that President Aquino has decided against giving priority to the bill in Congress this year.

Ramon San Pascual, Philippine Legislators Committee on Population and Development Foundation Inc. executive director, said the RH Bill's exclusion from priority bills was unexpected at a time when Filipino women, families, and parents had high hopes for Aquino to carry out a national policy in support of his pledge for responsible parenthood.

"This is the time that the President must act on behalf of poor women and families by standing firm on his promise to pursue responsible parenthood," he said.

"We urge him to reconsider the inclusion of RH bill as a priority bill that must be submitted to the LEDAC," referring to the Legislative-Executive Development Advisory Council.

San Pascual urged Aquino not to succumb to Catholic Church pressure.

Aquino must reconsider the inclusion of the bill among those he will submit to lawmakers during the LEDAC meeting set on Feb. 28, he added.

San Pascual said Malacañang should not use the unfinished dialogue with the CBCP as a lame excuse for not certifying the RH Bill as urgent.

"It would be unfair for women to continue to become hostage of a dialogue and debate that has been going on for the past ten years," he said.


Aquino disappoints Cayetano

Sen. Pia Cayetano expressed disappointment yesterday over Aquino's decision to withdraw the RH Bill from his list of priority bills to be submitted to Congress.

Aquino's move "indicates a leadership that is indecisive and vulnerable to pressure," she added.

Cayetano said Aquino's decision has effectively placed the RH Bill in the back burner in Congress.

"P-Noy's unwavering position on the principle of free and informed choice, especially for poor couples on family planning methods, had inspired legislators to proceed despite mounting pressure from the Church," she said

Cayetano said the Senate and the House of Representatives have been conducting hearings on the RH Bill over the last seven months to have the bill passed into law.

"What was worse was that the President pulled out the RH Bill from the list of priority bills at a time when the congressional hearings are about to be concluded and the plenary debates would commence," she said.

"Nevertheless, it's not too late for Malacañang to re-include the RH Bill in its priority legislative agenda.

"This will be a true test of the political will of this administration, as well as the President's sincerity and conviction."

During the hearing of the Senate committee on health and demography and youth, women and family relations yesterday, former health secretary Esperanza Cabral reiterated the need to have the RH Bill passed into law, not only to fulfill the international commitments of the country, but also to protect the welfare of mothers and their children.

Cabral said the country has entered into various conventions, treaties and other instruments without thinking about the implications of these moves.

"In some instances we do make positions because we are pressured by social, economic and political matters but in terms of the MDG (Millennium Development Goals), we did this because we felt it was important for us to take care of our mothers and children and achieving the MDG will benefit mothers and the country," she said.

"Health is a very important issue and along with the rest of the world we should aim to achieve these goals for the benefit of women and children and the country as a whole."

The Catholic Bishops' Conference of the Philippines (CBCP) has raised four points against the RH Bill.

The provision to provide access to artificial contraceptives is very dangerous because a lot of these have serious side effects, according to James Imbong of the CBCP's legal office.

The CBCP was also opposed to incorporating sex education in the curriculum of schools because this has been proven to cause problems in several countries that have tried this.

Imbong said that population control has also led to some communities being wiped out from the face of the earth.

In a recent pronouncement, Malacañang indicated that Aquino supports giving families an informed choice on family planning methods.

During its consultations with the CBCP, Malacañang was told by the bishops that there was no need for the passage of a law since the Department of Health was already implementing programs on reproductive health. – Helen Flores, Marvin Sy
